Criminal Law

Representation of defendants and complainants during the investigation and prosecution stages.

Criminal Law — Av. Emre Yıldız

Criminal proceedings directly affect a person's liberty and future. From the very first moment of the investigation until the judgment becomes final, the effective exercise of the right to defence is essential at every stage.

The Role of the Lawyer in Criminal Proceedings

Criminal law requires, from the moment a suspicion of crime arises, the protection of the individual's rights and the lawful conduct of the process. At every stage in which you take part as a defendant or complainant, obtaining professional support early is important, because the steps taken may lead to consequences that are difficult to reverse.

How Does the Process Work?

Criminal proceedings essentially consist of three stages:

  • Investigation: The prosecutor's office gathers evidence and statements are taken. At this stage, the assistance of defence counsel, the right to remain silent and the right to be informed of the accusation come into play.
  • Prosecution: With the acceptance of the indictment, the case is opened; evidence is discussed at hearings, witnesses are heard and the defence is presented.
  • Legal remedies: Review is provided through appeals on the merits (istinaf) and appeals to the Court of Cassation (temyiz) against the judgment.

In Which Situations Should You Seek Support?

  • Being detained, summoned for a statement or interrogation
  • Being subject to a complaint or criminal report
  • Detention on remand and judicial control measures
  • Asserting your rights as the victim of a crime (complainant / intervening party)
